CHARLESTON -- A truck driver is suing his employer after being fired after voicing concern over the long driving shifts.
Donald Fannin filed a lawsuit March 6 in Kanawha Circuit Court against Meyer Distributing Inc. and its general manager Brian Farley, citing retaliatory firing.
Fannin was hired on Jan. 17, 2012, and was a route driver for most of his employment there. He claims company management requested he violate Department of Transportation rules on multiple occasions, specifically relating to scheduled driving shifts and falsifying DOT logbooks to reflect times in line with regulations, the complaint said. Fannin complained after a near-accident and stated he would no longer work additional shifts and was fired, the complaint states.
Fannin is seeking general and special damages, including front and back pay, punitive damages, interest on judgment, pre-judgment interest and court costs.
