Temp worker files suit after injury

CHARLESTON -- A temporary worker is suing the company he was working for as labor after he was injured in a fall.


Griffin Swayne filed a lawsuit March 6 in Kanawha Circuit Court against Myers Transfer and Storage Systems, citing negligence.

The lawsuit states Swayne was working at Myers in Charleston on March 6, 2012, as a temporary employee when he was told to walk across horizontal wooden planks from the loading dock to the truck. The planks separated and he fell, sustaining injury, the complaint said.

Swayne is seeking exemplary and compensatory damaged to adequately compensate him for his injuries, pre and post judgment interest and court costs.

He is being represented by Paul S. Perfater of Myers and Perfater. The case has been assigned to Circuit Judge Tod J. Kaufman.
