Man says son was injured at Quick Check

BECKLEY -- A Raleigh County man is suing over claims his son was injured on the premises of a store.

Dayton Deal, father and next friend of Lane Deal, a minor, filed a lawsuit March 18 in Raleigh Circuit Court against Shiv Inc., doing business as Quick Check, citing negligence.

According to the complaint, on Sept. 2, 2012, Deal and his son were at the Quick Check in Cool Ridge when a defective rack fell on the child, who was younger than 7 years old at the time, breaking his femur. The defendant is accused of using a defective rack in a high-traffic area and using it to display products not intended for use with the rack.

Deal is seeking damages in an amount to be determined by the court.

He is being represented in the case by attorney Anthony R. Veneri.
