BECKLEY -- A Raleigh County man is suing a former employer, claiming he was unlawfully fired and treated poorly.
Jeromy Painter filed a lawsuit on March 12 in Raleigh Circuit Court against Raleigh General Hospital LLC and Phillip Bolt, citing violation of the Human Rights Act, Wage Payment and Collection Act and infliction of emotional distress.
Painter alleges he worked for the defendant in the security department and on Oct. 4, 2012, he was diagnosed with a brain tumor and went on medical leave. According to the claim, the defendant assured Painter he would have a job when he was better. Painter was able to come back to work on Dec. 21, 2012.
The suit alleges the defendant dramatically changed Painter's schedule and called him a 'liability' informing him he 'needed to be babysat,' after several days of poor treatment Painter received a letter in the mail informing him of his termination.
Painter is seeking backpay and benefits owed since date of termination, reinstatement, damages, attorney's fees and court costs.
He is being represented in the case by Beckely attorney Anthony M. Salvatore and Amy A. Osgood of Hewitt and Salvatore PLLC. The case has been assigned to Circuit Judge John A. Hutchinson.
