Man accuses Cabot Oil and Gas of causing landslide, contract breach

LOGAN -- A Logan County man is suing Cabot Oil and Gas, claiming they created landslide conditions on his property.

David Hicks filed a lawsuit March 17 in Logan Circuit Court against Cabot Oil and Gas Corporation and Randall Rexroad, citing negligence, breach of contract, trespass, nuisance and misrepresentation.

Hicks claims he entered into an agreement with the defendant to use a certain area of Hicks' property in order to reconstruct a mountain, at Hicks Hollow in Logan County, in order to create an access road for a gas well. The suit alleges they didn't keep to the terms of the contract by redirecting large quantities of water, mud, soil, rocks and debris onto Hicks' property, resulting in a landslide.

According to the brief, the defendant has also created access roads on Hicks' property that were not agreed upon in the contract.

Hicks is seeking damages in an amount to compensate him for his losses, attorney's fees and court costs.

He is being represented by Williamson attorney M. Timothy Koontz. The case has been assigned to Circuit Judge Eric H. O'Briant.
