Man says he was wrongly fired from Sam's Club

CHALESTON -- A man is suing his employer after he was fired after an injury.


Stephen Lovejoy filed a lawsuit March 19 in Kanawha Circuit Court against Sams East Inc., citing wrongful termination.

The lawsuit states Duncan was employed at Sam's Club at 2500 Mountaineer Blvd., and was injured on Feb. 7, 2012. He requested a workers' compensation form, which wasn't provided and requested to be off the schedule to have surgery related to his injury. Duncan was fired March 25, 2012, according to the complaint.

Duncan is seeking compensation for damages, plus court costs.

He is being represented by Edward G. Atkins of John R. Mitchell L.C. The case has been assigned to Circuit Judge Louis H. Bloom.
