On-the-job injury results in lawsuit

WINFIELD -- A Ripley couple is suing after the husband is injured while working.


James M. Bush and Stephanie Bush filed a lawsuit March 24 in Putnam Circuit Court against BBU Services of WV LLC and CNX Gas Co. LLC, citing deliberate exposure, negligence and loss of consortium.

The complaint states James Bush was employed by BBU as a driver and in the course of his duties he had to ascend a vessel that was more than six feet off the ground without any fall protection equipment or training.

While working performing his job on CNX's site, James fell approximately 10 feet when a pocket of pressure caused an untethered cap to strike the plaintiff in the face, according to the complaint.

James M. Bush and Stephanie Bush are seeking compensatory damages, costs and fees.

They are being represented in the case by Timothy C. Bailey and J. Ryan Stewart of Bucci Bailey and Javins LC and W. Kent Carper and Aaron L. Harrah of Hill, Peterson, Carper, Bee & Deitzler PLLC. The case has been assigned to Circuit Judge Joseph Reeder.
