MOOREFIELD -- A Hardy County bank is suing over claims a volunteer fire department has defaulted on payments for an engine.
Summit Community Bank Inc., filed a lawsuit March 26 in Hardy Circuit Court against Wharncliffe Volunteer Fire Department Inc.
According to the complaint, on Aug. 9, 2012, Wharncliffe Volunteer Fire Department entered into a lease-purchase agreement with Country Roads Leasing for a 3,000-gallon tanker fire engine.
The lawsuit says Country Roads then assigned the agreement to Summit Community Bank, and the defendant has failed to make the Aug. 9, 2013, and subsequent payments.
Summit Community Bank is seeking the $52,206 owed, plus interest.
It is being represented in the case by attorney Kathy M. Santa Barbara. The case has been assigned to Circuit Judge H. Charles Carl.
