FAYETTEVILLE-- A local doctor is being sued for almost $100,000.
Oak Hill Hospital Corp., doing business as Plateau Medical Center, filed a lawsuit April 4 in Fayette Circuit Court against Mary K. Coll D.O., citing breach of contract and unjust enrichment.
The complaint states, Mountain Medical Associates, Oak Hill Hospital and Coll entered into a salary subsidy recruitment agreement on Oct. 12, 2011. The plaintiff says it agreed to pay a salary subsidy payment of $10,500 to Coll each month for a year and the defendant agreed to repay the money to the plaintiff.
The agreement stated Coll did not have to repay the subsidy if she continued her medical practice in the community for 24 months following the conclusion of the subsidy period, otherwise the subsidy would be forgiven in 1/24th per month after the conclusion of the subsidy period, according to the complaint.
The court document states if the defendant stopped practicing in the community at any time during the forgiveness period, the subsidy payment was due immediately.
Coll stopped her full-time medical practice on March 25, 2013, five months into the forgiveness period, and has failed to repay the unforgiven salary subsidy payments to the plaintiff, according to the complaint.
The plaintiff is seeking $99,750, plus interest, costs and fees.
Oak Hill Hospital Corp. is being represented by Sam Fox, J. Thomas Clark and Caleb Knight of Flaherty Sensabaugh Bonasso and Thompson & Knight LLP. The case has been assigned to Circuit Judge John W. Hatcher Jr.
