POINT PLEASANT -- A Mason County man is suing over claims he sustained serious injuries after falling out of a tractor trailer.
Darren Rhodes filed a lawsuit April 3 in Mason Circuit Court against CMJ Inc., Matson Logistics Inc., Rite Aid Corporation, Jg Hunt Express LTD, Rupinderdeep Singh Sidhu, individually and as an employee of Matson Logistics Inc., Rite Aid Corporation, Jg Hunt Express LTD, and ten other unknown employees, citing negligence.
Rhodes claims he was injured while unloading his tractor trailer at the defendant Rite Aid's warehouse on Feb. 28, 2012. The suit alleges Rhodes's tractor trailer was locked in the dock while he was unloading his cargo.
According to the brief, defendant Sidhu negligently accelerated the gas without checking to see if Rhodes was finished in the trailer, causing the trailer to jerk forward and disconnected the trailer from the dock lock system. The jolt threw Rhodes out of the back of the trailer, resulting in him landing on his back and seriously injuring him.
Rhodes is seeking damages in an amount greater than the jurisdictional limits of the court, interest, attorneys fees and court costs.
He is being represented in the case by Point Pleasant attorney Bradley H. Layne of Kayser Layne and Clark PLLC.
