Couple sues woman over loan given for business

NEW CUMBERLAND -- A couple is suing a woman they loaned $20,000 in an oral agreement.

David and Mary Ann Whitehill filed a lawsuit March 20 in Hancock Circuit Court against Leann Whitehill, also known as Leann Bauer, citing breach of contract.

The lawsuit states in March of 2011, the Whitehills entered into an oral agreement to loan $20,000 for Leann Whitehill to open an insurance business at 3181 Pennsylvania Ave. The business was opened, but Whitehill has refused to pay the money back, according to the complaint.

David and Mary Ann Whitehill are seeking damages that include the original loan amount, interest, court costs and any additional award from a jury to cover their loss, annoyance, aggravation, inconvenience, and emotional distress.

They are represented by Sellitti, Nogay & McCune P.L.L.C. The case has been assigned to Circuit Judge David J. Sims.
