HUNTINGTON-- A West Virginia company is suing over claims it was unable to complete a real estate development project as planned due to contract breach.
Scott Hutchinson Enterprises Inc. filed a lawsuit April 10 in Cabell Circuit Court against H&T Technical Development Co., citing breach of contract, breach of implied warranty and negligence.
According to the complaint, the plaintiff and defendant entered into a contract for H&T Technical Development to provide engineering services to the plaintiff for an apartment development project.
The plaintiff alleges the defendant made repeated delays and mistakes, which constitute breach of contract.
In addition, Scott Hutchinson Enterprises contends the defendant rendered unworkmanlike services.
Scott Hutchinson Enterprises is seeking an undisclosed amount in damages.
The plaintiff is being represented in the case by attorney Jarrett D. Gerlach of Huddleston Bolen LLP. The case has been assigned to Circuit Judge Christopher D. Chiles.
