Tow truck driver blamed for wreck

FAYETTEVILLE -- A Fayette County man is suing over claims he was injured in a collision caused by a tow truck attempting to avoid a collision with another vehicle.

Bovy and Candy Ball filed a lawsuit April 10 in Fayette Circuit Court against Jasper W. and Patricia S. Byrd, Count A Tech Inventory SVC, Bill Ray Peters Jr., Hauling Reorganization II LLC, doing business as Glen Heavy Hauling LLC, and Glen Heavy Hauling LLC, citing negligence.

According to the complaint, Jasper W. Byrd was negligently exiting U.S. 19 in a Yukon SUV owned by Patricia Byrd and Count A Tech on Nov. 12, 2012, when he nearly collided with the vehicle being towed by a tow truck driven by Peters and owned by Hauling Reorganization and Glen Heavy Hauling.

The lawsuit states Peters swerved to avoid the collision and collided head-on with the vehicle driven by Bovy Ball, injuring the plaintiff.

The Balls are seeking more than $50,000 in damages.

They are being represented in the case by attorney Paul O. Clay Jr.
