Seaman says he was injured by water, noise

HUNTINGTON -- A seaman is suing over claims he was injured from contaminated water and loud noises.

Jeffrey W. Cutlip filed a lawsuit April 7 in the United States District Court for the Southern District of West Virginia at Huntington against AEP River Operations LLC and Indiana Michigan Power Co., citing Jones Act negligence, unseaworthiness and maintenance and cure.

According to the complaint, Cutlip was employed by the defendants as a seamen and was member of the crew of the M/V Boonesboro on April 7, 2011, to April 12, 2011, and was transferred to M/V James E. Pinson.

The plaintiff alleges the defendants were negligent in allowing drinking water on the M/V Boonesboro to be contaminated by Entamoeba Histolytica from improperly transferring potable water. As a result, the plaintiff sustained injuries.

In addition, Cutlip was exposed to unreasonably loud and continuous noises from the defendants’ vessels and other equipment that caused the plaintiff to sustain injuries, according to the complaint.

Cutlip is seeking damages in excess of $75,000, plus interest and costs.

He is being represented in the case by Joseph P. Moschetta and Stephen P. Moschetta of Moschetta Law Firm PC.
