Mine injury results in lawsuit against Arch Coal

BECKLEY -- A coal worker is suing his employers after he sustained an injury at work.

Donald R. Abner Jr. filed a lawsuit March 31 in Raleigh Circuit Court against Arch Coal Inc., doing business as Beckley Pocahontas Mine, also known as Beck Pocahontas Deep, ICG Beckley L.L.C. and North American Rebuild Company Inc., citing negligence.

The lawsuit states Abner was injured Jan. 18, 2013, on the job working near Eccles, Raleigh County.

Abner sustained serious and permanent injuries to his legs and other parts of his body, according to the complaint. North American was negligent in the design of the equipment that ran over Abner, the complaint states.

Abner is seeking damages that adequately compensate him for his injuries.

He is being represented by Anthony M. Salvatore of Hewitt and Salvatore P.L.L.C.
