Car dealer sued for causing accident

MOUNDSVILLE -- A Marshall County couple is suing over claims the husband and their son were injured in a collision in Moundsville.

Justin Morgan, individually and as guardian, father, and next of friend of Wesley Morgan, a minor, and Cecelia Morgan filed a lawsuit April 21 in Marshall Circuit Court against Davis L. Poling and Kimberly Poling, doing business as Poling's Pre-Owned Vehicles, citing negligence.

According to the complaint, Justin Morgan was driving north on W.Va. 2 near the intersection with Sixth Street in Moundsville on April 19, 2012, when Davis Poling, in the scope of his employment for Poling's Pre-Owned Vehicles, struck Morgan's vehicle with his own.

The lawsuit says Morgan and his son, Wesley Morgan, a passenger in the car, sustained injuries in the collision. The defendants are accused of negligence.

The Morgans are seeking damages including compensatory and general relief.

They are being represented in the case by attorney Shane M. Mallett. The case has been assigned to Circuit Judge Mark A. Karl.
