CHARLESTON -- A local doctor is being sued after allegedly failing to perform a necessary evaluation, which resulted in death.
Lisa Kinser, as administratrix of the estate of Robert E. Kinser, filed a lawsuit April 10 in Kanawha Circuit Court against Robert Brian Johnston MD.
The complaint states Robert Kinser was a patient of Johnston and underwent a health risk assessment Jan. 23, 2013, and scored a high health risk. Robert Kinser was found unresponsive and died from cardiac arrest April 1, 2013, according to the complaint.
The plaintiff alleges Johnston caused or significantly contributed to Robert Kinser's death by failing to perform a cardiac evaluation.
The plaintiff is seeking an undisclosed amount in damages.
Lisa Kinser is being represented in the case by Richard D. Lindsay of Tabor Lindsay & Associates PLLC. The case has been assigned to Circuit Judge James C. Stucky.
