Bank sues man for overdrawn account

KINGWOOD -- A bank is suing for the overdrawn balance on a customer's account.

First United Bank and Trust filed a lawsuit April 16 in Preston Circuit Court against Michael Hovatter, doing business as Hovatter Transport.

According to the complaint, Hovatter entered into an account agreement with First United Bank on April 8, 2013, but on Nov. 12, the account became negative and has an overdrawn balance of more than $9,800. Hovatter is accused of failing to pay the balance despite several notifications from the bank.

First United Bank is seeking the balance and costs of the suit.

It is being represented in the case by attorney James C. Eberly Jr. of Hidey, Coyle & Monteleone. The case has been assigned to Circuit Judge Lawrance J. Miller.
