HUNTINGTON -- The city of Milton is suing after it was not reimbursed for services rendered at the annual Pumpkin Festival.
The City of Milton filed a lawsuit April 15 in Cabell Circuit Court against West Virginia Pumpkin Festival, citing failure to pay for services, unjust enrichment and breach of contract.
The city alleges in the suit they provide traffic control and other services for the defendant annually at One Pumpkin Park in Milton.
According to the brief, the plaintiff sent invoices to the defendant for services provided for the 2011 and 2012 festivals in the amount of $7,359.54. The suit alleges the defendant has not paid for services rendered as they had done so in the past.
The plaintiffs are seeking damages deemed just to fully compensate the city for services, interest, attorney fees and court costs.
It is being represented in the case by Winfield attorney David B. Richardson of David B. Richardson Law Office. The case has been assigned to Circuit Judge Christopher D. Chiles.
