HUNTINGTON -- A West Virginia woman is suing Comenity Bank, claiming harassment.
Ashley Proctor filed a lawsuit April 16 in Cabell Circuit Court against Comenity Bank, citing violations of the Consumer Credit and Protection Act, negligence, infliction of emotional distress and invasion of privacy.
Proctor claims she received multiple phone calls from the defendants in order to annoy and harass her into paying debts owed the defendants. According to the claim, the defendants tried to collect the debts due in ways which are in direct violation of several laws put into place in the state of West Virginia.
Proctor is seeking damages, attorney's fees and court costs.
She is being represented by attorneys Hoyt Glazer, Benjamin M. Sheridan and Mitchell Lee Klein of Klein, Sheridan and Glazer. The case has been assigned to Circuit Judge Christopher D. Chiles.
