WHEELING -- Property owners are suing a Marcellus Shale gas plant company, claiming is is trespassing on their property.
Richard F. Vargo and Jade L. Goodnight filed a lawsuit April 21 in Northern District Court of West Virginia at Wheeling against Williams Ohio Valley Midstream LLC, formerly known as Caiman Eastern Midstream LLC, citing trespass.
The plaintiffs claim the defendants attempted to enter into an agreement with them for the use of their property in order to access an adjoining landowners' property in order to repair a pipeline located on it. According to the brief, the plaintiffs refused the offer of $100,000 from the defendant, but despite their refusal the defendant is intentionally trespassing on the plaintiffs' property.
The plaintiffs are seeking a declaration to forbid Williams from entering their property, damages, interest and any other relief they are entitled to.
They are being represented by Weirton attorney Daniel J. Guida of Guida Law Offices and Jonathan E. Turak of Gold, Khourey and Turack, L.C. The case has been assigned to Circuit Judge Bailey.
