HUNTINGTON -- A Cabell County woman is suing Erie Insurance Company and Potts Insurance Agency, claiming they purposely denied her insurance claim.
Kassie Locke filed a lawsuit April 15 in Cabell Circuit Court against Erie Insurance Company and Potts Insurance Agency Inc., citing breach of contract, Unfair Claims Practices Act and Insurance Regulations, negligence and common law bad faith.
Locke claims she purchased an insurance policy from the defendants prior to May 28, to insure her 2007 Pontiac.
The suit alleges Locke's car suffered extensive damages from an accident May 28. According to the brief, the defendant intentionally delayed and mishandled Locke's claim, in violation of West Virginia's statutory and common law, resulting in denied coverage.
Locke is seeking damages, refund of insurance premiums, interest, attorney's fees and court costs.
She is being represented by attorney D. Adrian Hoosier of The Hoosier Law Firm PLLC. The case has been assigned to Circuit Judge F. Jane Hustead.
