HUNTINGTON -- A property owner is suing a rest home and its owners over unpaid taxes and rent.
Piney Run Partners LLC filed a lawsuit April 8 in Cabell Circuit Court against Fairhaven Rest Home Inc. and its owners Ronald and Barbara McCall, citing breach of contract.
The lawsuit states Fairhaven Rest Home entered into a lease with option to purchase agreement with Piney Run on Sept. 1, 2008, for property at 700 Madison Ave., Huntington.
Real estate taxes for 2013 went unpaid, forcing Piney Run to pay $27,979 in taxes and also forced it to redeem the property from the state auditor, which costs $69,989.91, the complaint said. The rest home hasn’t paid rent for March and April 2014 in the sum of $22,500 per month, according to the complaint.
Piney Run Partners is seeking damages of $88,977.91 for the taxes, $45,000 for unpaid rent, interest on all unpaid debt, and $22,000 per month for any future unpaid rent, plus court costs.
It is being represented by Leon L. Oxley of Fraizer & Oxley LC. The case has been assigned to Circuit Judge Christopher D. Chiles.
