UTV accident results in lawsuit

MOUNDSVILLE -- A lawsuit has been filed after three people sustained injuries in a UTV accident.

Brenda Shaw, Griffin Shaw and Mackenzie Harbour, as mother and next friend of Cayne Green and Chandler Satterfield, minors, filed a lawsuit April 22 in Marshall Circuit Court against Polaris Industries Inc., citing strict liability, negligence, breach of implied warranties and breach of express warranties.

The complaint states Brenda Shaw was operating a Polaris UTV Ranger with Cayne Green and Chandler Satterfield as passengers June 20, 2012. When attempting to back the UTV out of its parking spot, the throttle experienced sudden and unintended acceleration in reverse gear, according to the complaint.

The court filing states, Brenda Shaw applied the brakes, but its power overrode the brakes, causing the UTV to travel over an embankment and flip over. The plaintiffs allege they sustained injuries in the accident.

The plaintiffs are seeking an undisclosed amount in damages.

The plaintiffs are being represented in the case by Gregory A. Gellner of Gellner Law Offices. The case has been assigned to Circuit Judge David W. Hummel.
