Putnam couple says pool company didn't do job in time

WINFIELD - A couple claims Precision Pools breached its contract with them by failing to complete a project in a timely manner.


On July 5, Shawn C. Gillispie and Lori Danielle Gillispie entered into a contract with Phillip Fox, who is doing business as Precision Pools, for the installation of a new pool liner and fiberglass steps at their home, according to a complaint filed April 10 in Putnam Circuit Court.


The Gillispies claim the total sum of the contract was for $6,700, which included the price of the new liner, new fiberglass steps and labor involved in the installation.


The plaintiffs paid the defendant $4,700 up front to purchase the new liner and fiberglass steps and the defendant advised that the work would be completed by Aug. 2, which was the plaintiffs' daughter's birthday, according to the suit.


The Gillispies claim the defendant did not begin work on the pool until July 30 despite numerous attempts to contact the defendant and leaving phone messages regarding the start of the job.


The defendant did not complete the work on the pool until one week after the date he had promised, according to the suit.


The Gillispies claim the defendant knew that the pool was a "wood wall" pool and that padding would need to be added over the wood walls prior to the new liner being installed, however, the padding was not added to the wood walls between the skimmers of the pool and the new line was installed directly against the wood walls of the pool.


When the old liner was removed, the defendant advised that the pool base must be added before the new liner could be installed, according to the suit, but, the defendant only applied the pool base to certain areas of the pool and left rough spots and rocks, which are now causing problems with the new liner.


The Gillispies claim after the installation of the new liner, it took several more days for the pool to fill with water and that the pool light, all at their expense.


After construction and installation, numerous issues have arose from the defendant's work on the plaintiffs' pool, according to the suit.


The Gillispies claim the pool loses water daily and has to be refilled each day.


The Gillispies are seeking compensatory damages. They are representing themselves.
