NEW CUMBERLAND -- A former senior internal auditor is filing a lawsuit alleging he was terminated for reporting inaccuracies.
Joseph P. Gargasz filed a lawsuit March 21 in Hancock Circuit Court against Mountaineer Park Inc.
The complaint states Gargasz was employed by Mountaineer Park in December 2010 as a senior internal auditor. The plaintiff says he observed the defendant's corporate director of internal audit filing inaccurate, incomplete and deceptive audit reports. Gargasz states he advised the Board of Directors about his concerns in August 2013.
The plaintiff was discharged Jan. 15, 2014, for expressing concern about the audit reports and in contravention of public policy, according to the complaint.
The plaintiff is seeking compensatory and punitive damages.
Gargasz is being represented in the case by Patrick S. Cassidy and Wray V. Voegelin of Cassidy, Cogan, Shapell & Voegelin LC. The case has been assigned to Circuit Judge Ronald E. Wilson.
