Putnam woman claims contractor breached contract

WINFIELD -- A Putnam County woman is suing after a construction company didn't keep their end of the agreement.

Patricia E. Buck filed a lawsuit April 24 in Putnam Circuit Court against LMC Construction LLC and Clinton Kirtley, citing breach of implied warranty, cancellation of contract by revocation of acceptance, breach of duty of good faith and negligence.

Buck claims she entered into an agreement with the defendants to renovate her bathroom and laundry area May 13, 2013. The suit alleges the defendants breached a duty of good faith by having unlicensed and unsupervised subcontrators and employees working on Buck's home. According to the brief, the defendants performed services on Buck's home in a careless and unworkmanlike manner, causing Buck damages.

Buck is seeking a refund of all monies paid to the defendants, damages to be determined at trial, attorney fees, interest and court costs.

She is being represented in the case by attorney Thomas H. Peyton of Peyton Law Firm PLLC. The case has been assigned to Circuit Judge Joseph Reeder.
