MADISON -- A man is suing over claims a relative's property was damaged after mine workers left a drainage pipe near her home.
Andrew Meek, as next friend of Carolyn Meek, filed a lawsuit in Boone Circuit Court against Cowgirl Up Inc. and the West Virginia Department of Environmental Protection, citing negligence.
According to the complaint, Carolyn Meek gave permission to WVDEP and Cowgirl Up to use her property in Gordon to access an abandoned mine for work the WVDEP promised would improve the community, after they made it clear that they could force the action if Meek refused.
The lawsuit states on April 26, 2012, Cowgirl Up left a drainage pipe pointing at Meek's home which flooded the property and caused great property damage.
Andrew Meek is seeking actual and punitive damages and attorney's fees.
He is representing himself in the case along with attorney Alex J. Shook of Hamstead, Williams & Shook PLLC.
