Wayne Co. man says paving company knocked down power lines, caused injury

HUNTINGTON -- A Wayne County man is suing over claims he was injured when a dump truck knocked power lines down on the highway.

Troy D. Finley filed a lawsuit April 22 in Cabell Circuit Court against Billy and Danny White and West Virginia Paving Inc., citing negligence.

According to the complaint, on Sept. 9, Danny White was operating a dump truck owned by Billy White, as a subcontractor for West Virginia Paving for a project on Interstate 64 in Huntington, when he unloaded asphalt and pulled away without lowering the truck's dump bed.

The lawsuit states the dump bed knocked down power lines which fell onto the truck Finley was driving, causing injury to the plaintiff.

Finley is seeking damages in an amount to be determined by the court.

He is being represented in the case by attorney Paul E. Biser of Fredeking & Fredeking Law Offices LC. The case has been assigned to Circuit Judge Christopher D. Chiles.
