CHARLESTON -- A West Virginia department is suing over claims a company's vehicle damaged highway property.
Paul A. Mattox Jr., commissioner, and the West Virginia Department of Transportation, Division of Highways, filed a lawsuit May 14 in Kanawha Circuit Court against Lotter Farms Inc.
According to the complaint, a tractor trailer owned by Lotter Farms was traveling northbound on Interstate 79 near Morgantown on May 15, 2013, when the driver lost control and the vehicle rolled over, causing damage to the guardrail.
The West Virginia Department of Transportation is seeking more than $6,000 in damages.
It is being represented in the case by attorney C. Brian Matko. The case has been assigned to Circuit Judge Paul Zakaib.
