CHARLESTON --- The state of West Virginia and the insurance commissioner are suing a business for failure to keep workers' compensation insurance coverage.
The state of West Virginia and the West Virginia Insurance Commissioner filed a lawsuit April 10 in Kanawha Circuit Court against Superior Steam Cleaning and Sand Blasting Inc., Douglas Humphrey, individually and as president of Superior Steam Cleaning and Sand Blasting Inc., and Lovey Humphrey, individually and as vice-president of Superior Steam Cleaning and Sand Blasting Inc., citing
According to the brief, the defendants failed to maintain coverage for workers' compensation insurance in violation of the laws in West Virginia.
The suit alleges the defendants owe the plaintiff $4,017.82 as a result of becoming uninsured April 17, 2013.
The plaintiff obtained coverage June 28, and the policy was cancelled at the request of the finance company Dec. 10, owing another fine of $7,737.60 and accruing additional fines of $1,934 monthly.
The plaintiffs are requesting the defendants stop doing business until all fines are paid and they provide proof of coverage, payment of the accumulated fines and they request the defendant be prohibited from selling or transferring any property belonging to either of the defendants until all fine are paid in full.
The plaintiffs are being represented by Charleston attorney David Ansell. The case has been to Circuit Judge James C. Stucky.
