Man says Wok and Roll wrongly fired him

CHARLESTON -- A West Virginia resident is suing a former employer, claiming he was fired without just cause.

Earl F. Propst filed a lawsuit May 14 in Kanawha Circuit Court against Wok and Roll of Charleston LLC, John Song and unknown people, citing unlawful retaliation and the West Virginia Wage Payment and Collection Act.

Propst alleges in the suit he worked for the defendants from September 2012 until January 4 when he was discharged from his delivery driver position. The suit alleges Propst was discharged from his position after a Department of Labor investigation showed the defendants had not paid Propst overtime wages due him.

Propst is seeking damages including lost wages and benefits, back pay, front pay, interest, attorney's fees and court costs.

He is being represented in the case by attorneys D. Adrian Hoosier II of The Hoosier Law Firm PLLC. The case has been assigned to Circuit Judge Paul Zakaib.
