McDowell Co. miner sues following work injury

PINEVILLE -- A McDowell County man is suing over claims he was injured when the hoist car in his employer's mine malfunctioned.

Matthew E. and Jessica Poore filed a lawsuit May 6 in Wyoming Circuit Court against Spartan Mining Company.

According to the complaint, Matthew Poore was employed as a shuttle car operator at Spartan's Road Fork No. 51 underground mine in Wyoming County on May 8, 2012, when the hoist car he was riding to the mine locked up and went into a free fall. Matthew Poore says when the emergency stop was activated, the abrupt stop caused him to suffer injury to his back, neck and shoulders.

The defendant is accused of having knowledge of the hoist car's disrepair due to multiple reports from employees and still failing to maintain the only means to enter the mine.

The Poores are seeking damages and attorney's fees.

They are being represented in the case by attorney J. Ryan Stewart of Bucci Bailey & Javins L.C.
