KEYSER -- A Mineral County homeowners association is suing over claims a company continues to obstruct a road with trucks and equipment.
Healy Heights Homeowners Association Inc. filed a lawsuit May 19 in Mineral Circuit Court against Kessel Lumber Products Inc.
According to the complaint, Kessel Lumber Products continues to obstruct Woodland Drive despite the deed that granted it access to the road, but required it remain unobstructed. Healy Heights Homeowners Association says it notified Kessel Lumber of its disregard for the order April 3, 2013, and again Feb. 28, but the defendant continues to obstruct the road with the storage of equipment, trucks and lumber.
Healy Heights Homeowners Association is seeking an order the defendant complies with the regulations and attorney's fees.
It is being represented in the case by attorney John I. Rogers II.
