Nicholas Co. woman files medmal case after ankle surgery

SUMMERSVILLE -- Nicholas County woman is suing after experiencing permanent injuries after ankle surgery.

Linda Jewell Wayne filed a lawsuit April 29 in Nicholas Circuit Court against Summersville Regional Medical Center, The Town of Summersville, doing buisiness as Summersville Regional Medical Center, Dr. Peter J. Spohn, Dr. Halberto Cruz and Dr. Colin A. Rose, citing negligence.

Wayne claims she was underwent surgery by Spohn to stabilize her right ankle with screws and a metal plate in an effort to heal a broken bone on March 2, 2012. The suit alleges the plaintiff misplaced at least one of the screws, causing pain, discomfort and permanent injury to Wayne including osteoporosis in the right ankle.

Wayne is seeking damages, attorneys fees and court costs.

She is being represented in the case by Charleston attorney Henry E. Wood III of Wood Law Office LC.
