SUMMERSVILLE -- Bundy Auger Mining company is suing an energy company for refusing to pay them for work completed.
Bundy Auger Mining Inc. filed a lawsuit May 1 in Nicholas Circuit Court against Spring Creek Energy Company LLC, citing breach of contract.
The plaintiffs claims it entered into a mining agreement with the defendant July 30, to mine and remove coal from a site in Nicholas County.
The suit alleges according to the contract the defendant was to pay $13 per ton of raw coal and $1 a ton for clean coal coming from the Steinert Separating Machine. According to the brief, the defendant has failed to pay the plaintiff for work done in the amount of $201,666.65.
The plaintiff is seeking damages, interest, attorney fees and court costs.
It is being represented in the case by attorneys Gregory W. Sproles of Gregory W. Sproles PLLC. The case has been assigned to Circuit Court Judge Gary Johnson.
