Chemical company takes another to court

WHEELING -- Sal Chemical Company is suing Klear Chemical Company for refusing to pay for chemical purchases.

Sal Chemical Company Inc. filed a lawsuit May 2 in Ohio Circuit Court against Klear LLC, doing business as Klear Chemical Company, citing breach of contract and unjust enrichment.

Sal Chemical claims it verbally agreed to supply the defendant with chemicals Sept. 10, requiring full payment within 30 days of receipt. The suit alleges the defendant has made partial payments as of April 25, but has refused to pay the remaining balance of $10,963.05.

The plaintiff is seeking damages in the amount of $10,963.05, interest at 18 percent, attorney fees and court costs.

It is being represented in the case by attorney Gerald E. Lofstead III of Spilman Thomas and Battle PLLC. The case has been assigned to Circuit Court Judge Wilson.
