WHEELING -- Sears Roebuck and Company and others are being sued over claims they refused to fix or replace a product under warranty.
Melissa Czahoroski filed a lawsuit May 2 in Ohio Circuit Court against Sears Roebuck and Co., citing warranty act, breach of contract, implied warranty and West Virginia Consumer Credit and Protection Act.
Czahoroski claims she purchased a Craftsman Turn Tight Garden Tractor and warranty coverage in April 2013. According to the brief, the garden tractor began having stability problems and almost flipped over on multiple occasions. The suit alleges the defendants unsuccessfully attempted to fix the problem and thereafter refused to fix, replace or refund Czahoroski's purchase.
Czahoroski is seeking damages in excess of $75,000 and court costs.
She is being represented in the case by Wheeling attorney Frank X. Duff of Schrader Byrd and Companion PLLC. The case has been assigned to Circuit Judge Ronald E. Wilson.
