Ohio woman says employer sexually harassed her

Sexualharassment

HUNTINGTON -- An Ohio woman is suing her employer, claiming sexual harassment.

Janet Schwartz filed a lawsuit May 27 in Cabell Circuit Court against Fairhaven Rest Home Inc., doing business as Madison Park, Madison Park, Ronald McCall, individually and as Vice President and Officer of Fairhaven Rest Home Inc., citing sexual harassment, battery, negligence, negligent hiring, failure to supervise and infliction of emotional distress.

Schwartz claims she was a housekeeper at the Madison Park senior citizen facility at 700 Madison Ave. in Huntington when she was sexually harassed by defendant McCall. The suit alleges McCall would poke Schwartz in the ribs, smack her buttocks, ask her inappropriate questions, follow her as she performed her duties, push her head down almost in her cleaning bucket and invited her into his home.

According to the brief, Schwartz reported the harassment, but it only escalated the issue.

Schwartz is seeking judgement to compensate her for her damages, attorney's fees, interest and court costs.

She is being represented by Charleston attorneys Lia DiTrapano Fairless of DiTrapano Law Firm PC and L. Tom Price of Tom Price Law PLLC. The case has been assigned to Circuit Judge F. Jane Hustead.
