Nurse says CAMC fired her after work injury

CHARLESTON -- A former health care worker is suing her employer on claims the company fired her because of a workplace injury.

Patricia Ann Marcum filed a lawsuit May 30 in Kanawha Circuit Court against CAMC Health System Inc., citing failure to accommodate and violations of the West Virginia Human Rights Act based on a perception of disability.

The lawsuit states Marcum began working for CAMC in January 2010 as a nurse and was discharged in March 2013 after a workplace injury in January 2013. The company refused to provide Marcum with an accommodation of modified duty and she was terminated and replaced while she was on leave, the complaint states.

Marcum is seeking damages including back pay, front pay, damages for indignity, embarrassment, humiliation, annoyance, inconvenience, emotional distress, punitive damages to be determined by a jury, pre and post-judgment interests, court costs and any other relief the court deems just.

She is being represented by D. Adrian Hoosier II of the Hoosier Law Firm P.L.L.C. of Charleston. The case has been assigned to Circuit Judge James C. Stucky.
