Wet floor at convenience store results in lawsuit

BECKLEY -- A Raleigh County man is suing over claims he was injured on the wet floor of a convenience store.

Robert J. and Brandie V. Holm filed a lawsuit May 6 in Raleigh Circuit Court against Little General Store Inc., citing negligence.

According to the complaint, Robert Holm was attempting to leave Little General Store on Robert C. Byrd Drive in MacArthur after purchasing items Sept. 27, when he slipped on a wet patch on the floor and fell and experienced pain. The complaint states Holm's pain increased after he went home, eventually requiring him to present to the hospital, where he was diagnosed with a sprain and the regression of recovery from an August surgery.

Holm says on Sept. 29, a shooting pain caused him to drop his daughter and his ability to assist his wife has since been impaired. The defendants are accused of negligence.

The Holms are seeking punitive and compensatory damages.

They are being represented in the case by attorneys David E. Gilbert and Todd A. Kirby of Kirby, Gilbert & Ashley L.C. in Beckley. The case has been assigned to Circuit Judge H. L. Kirkpatrick.
