Couple says Clayton Homes breached contract

BECKLEY -- A West Virginia couple are suing after a modular home company failed to follow through with a contract.

Charles Pittman Sr. and Lana Pittman filed a lawsuit May 12 in Raleigh Circuit Court against Clayton Homes, citing breach of contract and breach of warranty.

The plaintiffs claim they entered into a contract to purchase a modular home from the defendant on April 27, 2012. According to the brief, the contract stated the home was to be installed and all work done in an acceptable manner, which the defendant has refused to honor. The suit alleges the defendant failed to have all work done in a workman like manner and refused to honor all warranties on the home.

The plaintiffs are seeking damages in an amount justified by the evidence.

The case is being represented by Fayetteville attorney Greg A. Hewitt of Hewitt and Salvatore PLLC. The case has been assigned to Circuit Judge John A. Hutchison.
