MOUNDSVILLE — A class action lawsuit has been filed against a nursing home after employees claim money deducted for Christmas Club accounts was used by the company instead.
Jennifer Renshaw, individually and on behalf of a class of persons, filed a lawsuit May 30 in Marshall Circuit Court against Mound View Health Care Inc. and Pine View Nursing & Convalescent Home Inc., citing violation of the West Virginia Wage Payment and Collection Act, conversion and unjust enrichment.
The lawsuit states the nursing home corporation took money designated by employees to go to a Christmas Club fund out of each check, but delayed putting the money into the fund until just prior to October withdrawals.
Not all of the money has been reimbursed and the corporation never reimbursed for lost interest the money would have gained had it been put into the account promptly, the complaint states.
Renshaw seeks certification of the proposed class, a judgment for relief, injunctive relief, unpaid wages, benefits and other compensatory damages, liquidated damages, punitive damages, pre and post-judgment interest, court costs and all other appropriate relief.
She is represented by James G. Bordas III of Bordas & Boardas of Wheeling. The case has been assigned to Circuit Judge David W. Hummel.
