WHEELING – The estate of an Ohio County man is suing over claims he was fraudulently induced into superfluous purchases before his death.
The Estate of William A. Fluty and Wendy F. Hinerman, administratrix, filed a lawsuit June 12 in Ohio Circuit Court against Jim Robinson Ford Lincoln Inc. and Denny Yoho, citing fraud.
According to the complaint, Fluty purchased 11 vehicles from Jim Robinson Ford Lincoln from Sept. 26, 2011, to April 20, 2012, including trade-ins and purchases at or above the manufacturer's suggested retail price that were then gifted to individuals or organizations, for a total price of $446,400.
The lawsuit says Fluty took Yoho, a salesman for Robinson, into his trust regarding his finances, which allowed Yoho to exert control over Fluty's purchases. Hinerman says she was unaware of the unlawful behavior until after Fluty's June 13, 2012, death.
The defendants are accused of violations of the West Virginia Consumer Protection Act, fraud and breach of contract.
Hinerman is seeking damages within the jurisdiction of the court.
She is being represented in the case by attorneys Jeffrey A. Grove and David L. Delk Jr. of Grove & Delk LLC in Wheeling. The case has been assigned to Circuit Judge James P. Mazzone.
