SUMMERSVILLE - Branch Banking & Trust Co. is suing multiple companies and individuals for failing to pay on their promissory notes.
Multiplex Inc., Arthur R. Poff, Pamela Poff, West Virginia Tax Department Compliance Division and the Nicholas County Sheriff's Tax Office were all named as defendants in the suit.
On July 10, 2001, Arthur Poff and Pamela Poff executed and delivered to BB&T a promissory note in the principal sum of $70,957, which was modified and executed on July 10 for 2003, 2004, 2006, 2008, 2009, 2010; and Sept. 20, 2010, and Dec. 27, 2011, according to a complaint filed in Nicholas Circuit Court.
BB&T claims to secure payment of the promissory note, the Poffs executed and delivered a credit line deed of trust and security agreement on real estate in Nicholas County. On Oct. 28, 2002, the Poffs executed another promissory note, this time in the principal sum of $85,616,22, which was modified and executed on Nov. 3, 2005; Nov. 5, 2009; and Dec. 27, 2011, according to the suit.
"To secure payment...Arthur Poff executed and delivered to BB&T a credit line deed of trust and security...on...real estate," the complaint states.
BB&T claims Multiplex executed and delivered two promissory notes in the sums of $50,100, and $100,000. The defendants failed to make the required payments when due and are in default under the terms of the promissory notes, according to the suit.
BB&T claims the defendants guaranteed payment and failed to keep that guarantee.
BB&T is seeking judgment against the defendants for the amounts of $37,811.73, $31,960.04, $18,089.46 and $116,893.90 with interest.
