Kuenzel & Associates says client breached contract, failed to pay fees

LOGAN - A law office is suing a client after it claims he breached his contract and failed to pay his legal fees.

On Feb. 15, 2013, James G. Case engaged Kuenzel & Associates to represent him in a criminal matter that was pending in Mingo Magistrate Court, according to a complaint filed July 1 in Logan Circuit Court.

Kuenzel & Associates claims the matter was transferred to Mingo Family Court, and Case contracted the law office to represent him in all proceedings.

The defendant paid a portion of his legal fees, however, Case still owes legal fees and costs totaling $6,834, according to the suit.

Case's actions in failing to pay the balance of the monies owed under his contract with Kuenzel & Associates, and after having been provided notice on various occasions that the balance was due and owing, constitutes a breach of contract, according to the suit.

Kuenzel & Associates is seeking judgment in the amount of $6,834 with pre- and post-judgment interest. It is being represented by Robert B. Kuenzel.
