Man says he was fired after receiving workers' comp

LOGAN -- A West Virginia man is suing over claims his employment was terminated because he received workers' compensation benefits.

Nathaniel Hensley filed a lawsuit July 7 in Logan Circuit Court against McGrew PS/LT Tire Co. Inc. and Roger A. McGrew, citing retaliatory discharge.

According to the complaint, Hensley was employed by McGrew PS/LT Tire Co. when he was injured on the job Sept. 18. McGrew says he received disability benefits while recovering from his injury, but on Nov. 7, when he contacted the defendants to return to work, his employment was terminated.

The defendants are accused of violating the West Virginia Human Rights Act and workers' compensation retaliation/discrimination.

Hensley is seeking lost wages and benefits, back pay, front pay and damages.

He is being represented in the case by attorney Valentina G. Wheeler of Wheeler Law Firm PLLC in Charleston. The case has been assigned to Circuit Judge Roger L. Perry.
