LOGAN -- The owners of a Logan County property are suing after an electrical fire damaged the property.
Stella Murray, Tony Fortuna, Lois Fortuna, Michael Fortuna, Loretta Fortuna, Ronald Fortuna and Nickolena Fortuna filed a lawsuit July 7 in Logan Circuit Court against Appalachian Power Company and American Electric Power, citing negligence.
According to the complaint, on July 4, 2012, a fire erupted on a property in Crooked Creek jointly owned by the plaintiffs, causing severe damage and rendering it uninhabitable. The plaintiffs say the fire was caused by the negligence of the defendants, who sent a power surge through lines leading to the property and failed to inspect the power lines.
The claim also states the defendants committed spoilation of evidence by removing wiring from the breaker box and electrical apparatuses on the property.
The plaintiffs are seeking special damages, interest and costs.
They are being represented in the case by attorneys Douglas Witten, Donald C. Wandling and David Wandling of Avis, Witten & Wandling L.C. in Logan. The case has been assigned to Circuit Judge Roger L. Perry.
