RIPLEY - A man is suing Constellium Rolled Products Ravenswood LLC after he claims it violated the West Virginia Wage Payment and Collection Act and caused him and others damages.
William B. Woolum was employed by Constellium and claimed it breached its duty owed to him and former employees under the West Virginia Wage Payment and Collection Act, according to a complaint filed June 3 in Jackson Circuit Court.
Woolum claims the defendant violated the WPCA by failing to pay its former discharged employees within the time periods required by the law.
"To enforce West Virginia law and to stop this practice, the plaintiff brings this action on his own behalf and on behalf of other employees of the defendant who were discharged and whose wages were not paid within the period of time required by law," the complaint states.
Woolum claims the defendant failed to pay him and others their employment wages in full within the time limits required by the WPCA.
The defendant's actions entitle Woolum and others to treble damages, according to the suit.
Woolum is seeking compensatory damages. He is being represented by Todd S. Bailess and Joy B. Mega of Bailess Law PLLC; and Rodney A. Smith and Jonathan R. Marshall of Bailey & Glasser LLP.
The case has been assigned to Circuit Judge Thomas C. Evans III.
