Mount Hope company wants paid for rock dusters

FAYETTTEVILLE – A Mount Hope-based company has filed a lawsuit against a Glen Lyn-based company for goods sold and delivered.

TDT LLC filed a lawsuit July 17 in Fayette Circuit Court against G.E. Fairchild LLC, also known as GE Mining, also known as Fairchild, also known as Fairchild International.

According to the complaint, the plaintiff has delivered 10 rock dusters between Feb. 20, 2012, and Oct. 22, 2012, to the defendant. Each rock duster had a unit price of $9,850, but the defendant has failed to pay for the goods, the suit states.

Rockdusting is the practice of applying rock dust to coal dust to reduce the risk of igniting and exploding in active mining areas.

The plaintiff seeks a judgment of $98,500 plus interest and court costs.

TDT is represented by attorney Philip J. Tissue of Oak Hill. The case has been assigned to Circuit Judge Paul M. Blake.
